These Terms of Use govern access to and use of the ProViability platform ("Platform"), a software-as-a-service for real estate development feasibility analysis. By creating an account or using the Platform, you declare that you have read and fully agree to these Terms and to the Cookie Policy.
1. Service description
The Platform lets organizations register land parcels and developments and, from the assumptions provided, obtain calculations and indicators to support feasibility analysis, including:
- product configuration (areas, units, total sales value, floor area ratio and parking spaces);
- cost structuring, sales curve, installment plans and monetary correction by economic indices;
- project result, diagnostics and automatic alerts;
- a consolidated dashboard of the organization's portfolio.
Other features are under development, such as monthly cash flow and financial indicators (IRR, NPV, Payback), financing structuring, sensitivity simulations, consolidated reports and market data. Features marked "coming soon" or not yet available are not part of the contracted service until they are actually launched, and there is no committed date for their availability.
2. Registration and organizational account
Registration creates an organizational account linked to the company entered on the registration form. The user who registers is set as the "owner" of that organization.
- You are responsible for the accuracy of the information provided and for keeping it up to date.
- You are responsible for keeping your password confidential and for all activity carried out with your credentials. When using the "Remember me" option, avoid doing so on shared computers.
- Report any unauthorized use of your account immediately through the contact listed at the end of these Terms.
3. Plans, trial period and subscription
Every new organization receives a free 14 (fourteen) day trial period, with access to the Professional plan's features. Available plans, their prices and features are those published on the home page and on the Platform's "Plans" screen.
- When the trial period ends without a plan being subscribed to, access to the Platform's workspace is blocked, and only the plans screen remains available for subscription.
- Blocking due to trial expiration does not automatically delete the data registered by the organization; access to it is restored once a plan is subscribed to.
- At present, subscription is carried out by contacting the sales team. Payment, billing, renewal and cancellation terms are agreed upon during that process and may be incorporated into the Platform in the future, with an update to these Terms.
- Plan prices and features may be changed, with prior notice to organizations with an active subscription.
4. Nature of the results
The calculations, indicators, diagnostics, alerts and suggestions presented by the Platform are estimates produced from the assumptions entered by the user and calculation models that adopt simplifications relative to a full feasibility study. In particular:
- the results do not constitute financial, accounting, legal, engineering, urban planning or investment advice, and do not replace analysis by qualified professionals;
- urban planning parameters (floor area ratio, site coverage ratio, parking, etc.) must always be confirmed against applicable municipal legislation and the relevant authorities;
- default values and percentages suggested by the Platform (such as target margin and construction weights) are generic references that must be reviewed by the organization for each case;
- the decision to invest in, build, sell or finance a development is the sole responsibility of the user and their organization.
5. Third-party data
At the user's request, the Platform allows importing historical series of economic indices (such as INCC-M and IGP-M) made publicly available by the Central Bank of Brazil. ProViability does not guarantee the availability, accuracy or timeliness of this third-party data. Indices entered or projected manually by the user are the user's sole responsibility.
6. Data ownership and isolation
Information entered into the Platform (land parcels, developments, assumptions, indices and settings) belongs to the organization that entered it and is accessible only to users linked to that organization. ProViability does not sell this data or share it with other organizations.
7. Access by the support team
For technical support, troubleshooting, security and account management purposes, ProViability administrators may access an organization's data, view the Platform as that organization sees it, activate or deactivate users, and change the plan or subscription status. This access is restricted to authorized staff and used only for these purposes.
8. Personal data
To provide the service, ProViability processes users' personal data in accordance with Brazil's General Data Protection Law (Law No. 13,709/2018 — LGPD):
- Registration data: the user's name, email and password (stored encrypted); the organization's name and phone number.
- Session data: IP address, browser information and access time, recorded to maintain the authenticated session and for security purposes.
- Communications: the registered email is used for account-related messages, such as password resets.
This data is used to perform the contract, comply with legal obligations and secure the Platform. You may request access to, correction of, or deletion of your personal data through the contact listed at the end of these Terms; name, email and password can also be changed directly on the "My Account" screen.
9. Acceptable use
You agree to use the Platform lawfully and, in particular, not to:
- attempt to access other organizations' data or bypass authentication, isolation and access control mechanisms;
- reverse-engineer, copy or resell the Platform, or use it to develop a competing product;
- intentionally overload the infrastructure or use unauthorized automated means;
- enter unlawful content or content that infringes third-party rights.
Failure to comply with these rules may lead to the suspension or deactivation of the users involved or of the organization.
10. Intellectual property
The software, brand, layout, calculation models and other elements of the Platform belong to ProViability. Subscribing grants the organization only a non-exclusive, non-transferable right of use for the duration of its access.
11. Availability, changes and liability
ProViability strives to keep the Platform available and functioning correctly, but does not guarantee that it is free of interruptions or errors. Features may be changed, suspended or discontinued, with reasonable notice where applicable. To the fullest extent permitted by law, ProViability is not liable for decisions made based on the Platform's results, nor for lost profits or indirect damages arising from its use.
12. Changes to these Terms
These Terms may be updated to reflect changes to the Platform or to the law. The last update date is shown at the top of this page. Material changes will be communicated to users, and continued use of the Platform after such communication constitutes agreement with the new version.
13. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil.
